12 Mar 1707/8. DRAFT CONTRACT FOR RENTING FARM LAND. Bundle 5, Doc 28. 39 cm x 32 cm. Very fragile with lots of small holes and crumpled edges. Articles of Agre[em]t made Indented Concluded and Agreed upon the twelveth day of March in the yeare 17078 Between Jeff. BECK of Ednall in the County of Cumberland steward one the pt and behalfe of hhe hon~ble Chr MUSGRAVE Esqr on the first pt and Andrew WHELPDALE of Hujgill [?] in the County of Cumberland Gentleman & Tho SUTTON of Penrith in the sd Couty Gen~ on the other pt Imp~s It is Covenanted and agreed upon between these parties that the sd J BECK on the pt. and behalfe of the sd Chr MUSGRAVE doe sett and to farme let unto the sd Andrew WHELPDALE & Thomas SUTTON all the pasture meadow & Arable Gound Lying neare Penrith laately in farme to Wm TYSON of Penrith being parcell of the demisne Lying nere Penrith That is to say Borbank Close Red Friyes Hutton Lyses [?] Rield [?] Ings – Great Ings – Guley Flat Marian Maines Great & Little Maines To have & to hold the sed sevreall Closes mencioned for the space and Terme of 6 yeares to Comencing from the fifteenth of April next after the date and to Continue for the full Terme of 6 years or att the or att the respective time the sd Andrew WHELPDALE & Tho SUTTON to Enter to Resigne deliver up the same att the End of 6 yeares and none of the Grounds to be broken up or plowed what [?] what is J Gilage Except that is to say great & little maines & the sd Andrew WHELPDALE Thomas SUTTONON do prom [?] it of brelany [?] the suffrer lastly to manuer the sd tow Closes accesorrye [?] to the usuall way of good husbandry and to Leave the hedges & fences in as good order as they are att the Enterance there unto & all Inclosures to be Keput up as usuall That In Consideracon there of the Lands above mencion~ the sd Andrew WHELPDALE & Tho SUTTON shall pay or cause to be pd unto the sd Chr MUSGRAVE or any Impowered by him to receive itt the yearely Rent & Sum of 26 pounds of Lawfull money of Great Britan by two Equall paymts in the yeare that is to say Marts and & May Day yearly dureing the Terme of 6 years Suply [?] The sd Andrew WHELPDALE and Thomas SUTTON That the sd Jeff BECK on the pt and behalfe of the sd Chr MUSGRAVE shall not plow of the above mencioned Gruns above 5 acres yearly dureing the Terme
